Terms of Service (AGB)

Welcome to Fanunity Network. These Terms of Service ("Terms") govern your use of the Fanunity platform, website, and related services.

1. Acceptance of Terms

By accessing or using our platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use Fanunity.

2. Description of Service

Fanunity provides a digital ecosystem where fans can interact with sports clubs, participate in crowd-funding campaigns, join Fan Collectives, cast votes, and purchase merchandise or subscriptions. The platform acts as an intermediary infrastructure facilitating community organization and engagement.

3. User Accounts

To use certain features, you must register for an account. You agree to provide accurate, current, and complete information and keep it updated. You are responsible for safeguarding your login credentials (such as Google or Apple login tokens) and are solely responsible for activities occurring under your account.

4. Payments and Subscriptions

  • Purchases: Pledges, subscriptions, and purchases made on Fanunity are processed securely by third-party payment providers (e.g., Stripe).
  • Fan Subscriptions: You authorize Fanunity to charge your selected payment method on a recurring basis for club subscriptions until canceled.
  • Refunds: Pledges to campaigns are generally non-refundable unless the campaign fails to meet its minimum criteria as clearly stated on the campaign page, or as mandated by EU consumer law.

5. User Conduct and User-Generated Content (Haftungsausschluss)

You retain ownership of the content you post, but grant Fanunity a worldwide, non-exclusive license to use, display, and distribute your content across the platform.

Rule of Conduct: You agree not to post content that is illegal, offensive, discriminatory, or infringes on third-party intellectual property rights.

Disclaimer: Fanunity Network UG i.G. provides the infrastructure for Fan Collectives and club discussions. We are not responsible or liable for the actions, posts, campaigns, or real-world activities organized by independent Fan Collectives or Clubs. User-generated content does not reflect the views of Fanunity.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Fanunity Network UG i.G. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the service or any unauthorized access to our servers. Services are provided "as is" without warranty.

7. Modifications to the Service and Terms

We reserve the right to modify or discontinue, temporarily or permanently, the service with or without notice. We may also revise these Terms from time to time; the most current version will always be available on our website.

8. Governing Law

These Terms shall be governed according to the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For merchants, the place of jurisdiction is the seat of Fanunity Network UG i.G.
